Photo Animate provides online AI tools that help users animate photos, create image-to-video outputs, and enhance visual memories. By accessing or using the service, you agree to these Terms of Service.

1. Service use
You may use Photo Animate only for lawful purposes and only with images, audio, and prompts that you have the right to upload and process. You may not use the service to violate privacy, publicity, copyright, or other third-party rights.

2. Accounts and access
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. We may suspend or terminate access if we detect fraud, abuse, illegal activity, or behavior that harms the platform.

3. User content
You retain ownership of the content you upload. You grant Photo Animate a limited license to host, process, transmit, and store that content solely to operate, secure, improve, and support the service.

4. Generated output
AI-generated outputs may vary based on input quality, prompts, and model behavior. You are responsible for reviewing outputs before using, publishing, or sharing them. Do not rely on generated media for legal, medical, identity, or safety-critical purposes.

5. Payments
Paid plans, credits, or subscriptions are billed according to the pricing shown at checkout. Taxes may apply where required. Charges are generally non-refundable except as stated in our Refund Policy or where required by applicable law.

6. Prohibited uses
You may not use Photo Animate to create unlawful, deceptive, defamatory, exploitative, hateful, or sexually explicit material involving minors, or to impersonate real people in a harmful way. You may not attempt to reverse engineer, disrupt, or overload the service.

7. Availability and changes
We may update, improve, limit, or discontinue features at any time. We do not guarantee uninterrupted availability, specific generation speeds, or permanent storage of uploaded files or outputs unless explicitly stated.

8. Disclaimer of warranties
The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted service.

9. Limitation of liability
To the maximum extent permitted by law, Photo Animate and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, profits, or goodwill arising from your use of the service.
