1. Acceptance of Terms
Welcome to Photo Animate ("Photo Animate", "we", "us", or "our"), the AI photo animation service accessible at https://photoanimate.org (the "Service"). These Terms of Service ("Terms") govern your access to and use of the Service, which includes AI tools that animate photos into videos, enhance portraits, and generate image-to-video outputs.

By creating an account, subscribing to a plan, purchasing credits, or otherwise using the Service, you represent that you: (a) are at least 18 years old; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy, available at https://photoanimate.org/privacy-policy; and (d) have the authority to bind yourself or the organization you represent.

IMPORTANT: If you do not agree to these Terms, please stop using the Service. Continued use of the Service after the Terms are updated constitutes acceptance of the revised Terms.

2. Service Description

2.1 What we provide
Photo Animate provides an AI-powered platform that lets you animate still photos into short videos, add natural facial motion to portraits, restore and enhance old photos, and create image-to-video outputs. The Service is a digital Software-as-a-Service (SaaS) product delivered over the internet.

2.2 Nature of the Service
The Service is a digital, intangible product. Access is granted immediately after payment is confirmed. Due to the instant-delivery nature of digital services, refunds are subject to specific limitations as described in Section 7.

2.3 AI model dependency
The Service relies on third-party AI model providers. The performance and availability of the Service may be affected by the operational status of those providers. We will notify users of significant outages where possible.

3. Account Registration

3.1 Account creation
Using the Service requires creating an account with accurate and complete information. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

3.2 Account security
- If you discover unauthorized use of your account, contact [email protected] immediately.
- Do not share your login credentials with any third party.
- Keep the email address used for billing valid and accessible.

3.3 Business accounts
If you register on behalf of a company or other organization, you represent that you are authorized to bind that entity to these Terms.

4. Subscription Plans
We offer subscription plans to access the Service. Plans are offered on a monthly and yearly basis and include a monthly allowance of generation credits. Current plan details and pricing are shown at checkout and on our pricing page.

We may modify plan features or introduce new plans at any time. Price changes are governed by Section 5.1.

5. Billing and Payment

5.1 Automatic renewal authorization
By providing a payment method and subscribing to a paid plan, you expressly authorize Photo Animate to charge your payment method the applicable subscription fee on a recurring basis (monthly or yearly, depending on the plan you select). This recurring authorization remains in effect until you cancel as described in Section 6.

Your subscription automatically renews at the end of each billing cycle unless you cancel. For yearly subscriptions, we will send a reminder before each renewal charge.

5.2 Taxes
Unless otherwise stated, listed prices exclude applicable taxes (including VAT, GST, and sales tax). Where required by law, taxes are calculated and collected at checkout.

6. Cancellation Policy

6.1 How to cancel
You may cancel your subscription at any time by either of the following methods:
- Online (recommended): go to the pricing page and click "Cancel anytime", which opens the payment portal where you can cancel your subscription
- Email: send a cancellation request from your registered email address to [email protected]

Cancellation stops all future renewals. We will send a confirmation email after the cancellation is processed.

6.2 Effect of cancellation
- Your subscription remains active until the end of the current billing period.
- You will not be charged for subsequent billing cycles.
- Your account data is retained for 90 days after cancellation, after which it is deleted in accordance with our Privacy Policy.

7. Refund Policy

7.1 General policy
Due to the instant-delivery, intangible nature of our digital service, subscription fees are generally non-refundable, except as set forth below. For full details, see our Refund Policy at https://photoanimate.org/refund-policy.

7.2 Refundable situations
Requests must be submitted within 7 days of the original charge. Refunds may be granted for:
- Duplicate charges caused by billing errors (full refund).
- Verified technical failures attributable to us that prevented reasonable use of the Service (full or partial refund at our discretion).
- Billing issues that could not be resolved through support.
- Statutory rights: where applicable law grants you a withdrawal or refund right (for example, the 14-day cooling-off period in the EU/UK), those rights are preserved.

7.3 How to request a refund
Send your request to [email protected] with your account email, transaction ID, and the reason for the request. We will acknowledge requests within 2 business days and process approved refunds within 5-10 business days to the original payment method.

7.4 Non-refundable items
- Subscription fees for billing periods in which the Service was used (except as provided in Section 7.2).
- Requests submitted more than 7 days after the original charge, except where prohibited by applicable law.
- Accounts terminated for violation of these Terms or the Acceptable Use Policy in Section 10.

8. Billing Disputes
If you believe a charge is incorrect, please contact [email protected] before filing a dispute with your bank or card issuer. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.

9. AI Content and Intellectual Property

9.1 Ownership of output
Subject to your compliance with these Terms, AI content generated from your inputs ("Output") is owned by you. You may use Output for any lawful purpose permitted by Section 10.

9.2 License to input content
By submitting content to the Service ("Input"), you grant Photo Animate a limited, non-exclusive license to use it solely to provide the Service to you. We will not use your Input to train AI models without your explicit consent.

9.3 Third-party AI model dependency
The Service uses third-party AI model providers. Output may be influenced by those providers' models. We do not warrant any specific output quality and are not responsible for content generated by third-party models.

9.4 Accuracy of AI output
AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying Output before relying on, publishing, or sharing it.

10. Acceptable Use Policy

This Section 10 is our Acceptable Use Policy (AUP) for AI-generated content. It applies to all content you submit to the Service ("Input", including text prompts and uploaded images) and all content the Service generates for you ("Output", including AI-generated images and videos).

10.1 Content standards — prohibited categories
You may use the Service only for lawful purposes in accordance with these Terms. You may only upload images of identifiable people if you have the right to use those images and, where required, the consent of the person depicted.

You are strictly prohibited from using the Service to generate the following categories of content:
1. Pornographic or NSFW content: sexually explicit material, including nudity or sexual acts presented for sexual purposes.
2. Violent or gory content: graphic or gratuitous violence, gore, or content that glorifies violence or abuse.
3. Hate speech: content that attacks, demeans, dehumanizes, or discriminates against individuals or groups based on race, ethnicity, national origin, religion, disability, gender, gender identity, age, or sexual orientation.
4. Child unsafe content (CSAM): any content that sexualizes minors, exploits children, or violates child protection laws.
5. Deepfake or impersonation content: AI-synthesized video or images that impersonate a real person in a misleading or harmful way, or that mislead viewers about their origin or authenticity.
6. Copyright- or trademark-infringing content: unauthorized use or reproduction of copyrighted characters, artworks, brands, logos, or other protected intellectual property.

10.2 Zero-tolerance content
The following are absolutely prohibited on the Service. We take immediate action upon discovery and reserve the right to report such content to the competent authorities:
- Child sexual abuse material (CSAM) or any sexual content involving minors.
- Content that promotes or assists terrorism, violent extremism, or mass violence.
- Instructions for creating weapons of mass destruction.
- Content that incites genocide or ethnic hatred.
- Non-consensual sexual deepfake content targeting any real person.

10.3 Prohibited uses
In addition to the content standards above, you agree not to use the Service to:
- Generate illegal, defamatory, harassing, or fraudulent content, or misinformation presented as fact.
- Generate political content, including content involving political figures, political propaganda, or other politically sensitive material.
- Create malware, phishing content, or cyberattack tools.
- Impersonate any real person, brand, or organization, or infringe any third party's intellectual property, privacy, or publicity rights.
- Generate bulk spam or fraudulent content, or submit jailbreak prompts intended to bypass the Service's safety mechanisms.
- Circumvent or interfere with the security features of the Service.
- Resell or sublicense access to the Service without prior written approval.
- Violate any applicable law, regulation, or card network rules.

10.4 AI-specific prohibitions
In addition to the general prohibitions above, given the AI-based nature of the Service, you specifically agree not to:
- Use the Service's inputs, outputs, model responses, or any derivative data to train, fine-tune, benchmark, distill, or otherwise develop any AI or machine learning model that competes with the Service or Photo Animate's products.
- Systematically scrape or collect model outputs at scale for any purpose beyond your authorized personal use.
- Present AI-generated content as the work of a licensed human professional (such as a physician, lawyer, or financial advisor) in contexts where doing so could cause harm.

10.5 Content moderation
We operate a layered content moderation system that screens both Inputs and Outputs:
- Input filtering (real time): every text prompt is screened against a banned-keyword library covering NSFW terms, child-safety terms, copyrighted characters and brand names, violence and hate-speech terms, and real-person names used for impersonation. Prompts then pass through a semantic safety classifier (Waffo Prompt Sift, with an automatic fallback classifier when the primary service is unavailable). Uploaded images are checked with automated NSFW image detection before generation.
- Output filtering: generated results are screened with automated NSFW detection before they are delivered to you.
- Human review: content flagged by the automated systems, as well as user reports, is reviewed by our team.
- Audit logging: every moderation decision is recorded in audit logs so that we can review accuracy and improve the system.

10.6 Reporting violations
If you encounter content on the Service that violates this AUP — in particular child safety, terrorism, impersonation, or rights-infringement issues — please report it to [email protected]. Include a link to or description of the content and, where possible, the date and the account involved.
- Confidentiality: we keep the identity of reporters confidential to the extent permitted by law.
- Impartiality: every report is reviewed objectively and impartially.
- Anti-abuse: knowingly false or malicious reports may be recorded and treated as abuse of the reporting mechanism.
We aim to acknowledge reports within 2 business days. Confirmed child-safety and terrorism reports are handled on an expedited basis with the highest priority.

10.7 Enforcement
Violations of this AUP may result in enforcement measures proportionate to the severity and frequency of the violation:
1. Warning: written notice requiring you to remove or modify the content (first minor violation).
2. Content removal: removal of violating content and related outputs.
3. Feature restrictions: reduced generation limits or restricted feature access.
4. Account suspension: temporary suspension pending review.
5. Permanent ban: permanent termination of access, without refund for the terminated period (see Section 7.4).
6. Legal referral: reporting to law enforcement authorities and cooperation with investigations where content may be illegal.
Suspected CSAM, terrorism, and other zero-tolerance violations (Section 10.2) are handled immediately at the most severe applicable level.

10.8 Appeals
If your content was removed or your account was restricted and you believe this was an error, you may appeal within 14 days of the notice by emailing [email protected]. Appeals are reviewed by personnel who were not involved in the original decision, and we aim to complete the review within 10 business days.

11. Data, Privacy, and Security
Your use of the Service is governed by our Privacy Policy, published at https://photoanimate.org/privacy-policy. Payment card data is handled exclusively by our PCI-DSS compliant payment processors and is never stored on our servers. Account data is retained for 90 days after cancellation and then deleted.

12. Disclaimers and Limitation of Liability

12.1 Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy of AI output.

12.2 AI-generated content disclaimer
AI output from the Service may be inaccurate, incomplete, or outdated. Do not use it as legal, medical, financial, or other professional advice. Always verify AI content with a qualified professional before acting on it.

12.3 Limitation of liability
To the maximum extent permitted by applicable law, Photo Animate and its operators shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, revenue, profits, or goodwill arising from your use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.

13. Term and Termination
These Terms remain in effect while you use the Service. We may suspend or terminate your account if you materially breach these Terms, engage in suspected fraud, or where required by law. If we terminate the Service for reasons other than your breach, we will provide a pro-rata refund of prepaid, unused subscription time. You may delete your account at any time by contacting [email protected].

14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which Photo Animate's operator is established, without regard to conflict-of-laws rules. Before initiating formal proceedings, please contact [email protected] so we can try to resolve the matter informally.

15. General Terms
We may update these Terms from time to time. Material changes will be notified by email or on-site notice at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance. If any provision is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Photo Animate.
